Initiative 71: The Complete Guide to Legal Weed in DC

Initiative 71 changed the cannabis landscape in Washington DC forever. Passed by an overwhelming 70% of DC voters in November 2014, this ballot measure legalized the possession, use, and home cultivation of recreational marijuana for adults 21 and older in the District of Columbia.

But Initiative 71 is not like cannabis legalization in other states. Because DC is a federal district governed by Congress, the path to full commercialization has been blocked. Congress has repeatedly used its appropriations power to prevent the DC Council from taxing and regulating marijuana sales, creating the unique situation DC finds itself in today.

Under Initiative 71, adults 21 and over can possess up to two ounces of marijuana, grow up to six cannabis plants at home (with no more than three being mature at any time), and transfer — or gift — up to one ounce to another adult. This gifting provision is what gave rise to DC's distinctive cannabis economy.

The gifting model works like this: a business sells a legal product or service — it could be a t-shirt, a piece of art, a sticker, or a consultation service — and includes cannabis as a complimentary gift with the purchase. The cannabis itself is never directly sold. This creative interpretation of the law has allowed a thriving cannabis community to develop in DC.

For consumers, this means the experience of obtaining cannabis in DC is different from walking into a dispensary in Colorado or California. You typically browse a menu online, place an order, and receive your cannabis gift when you pick up or receive your purchased item. Established providers like Select Co-Op have refined this process to be as smooth and professional as any retail experience.

It is important to remember what remains illegal: you cannot consume cannabis in public spaces, on federal property (which includes the National Mall and many areas in DC), or while operating a vehicle. You also cannot sell cannabis without proper licensing, and you cannot possess more than two ounces outside your home.

For visitors to DC from Northern Virginia, Maryland, or elsewhere, Initiative 71 rights apply while you are within the District. However, transporting cannabis across state or district lines remains a federal offense, even between jurisdictions where it is legal.
